First International Convention on Artificial Intelligence Opened for Signature
The Council of Europe Framework Convention on Artificial Intelligence, Human Rights, Democracy and the Rule of Law (“AI Framework Convention”), the first-ever international legally binding treaty on artificial intelligence, opened for signature on 05.09.2024. AI Framework Convention aims to ensure that activities within the lifecycle of artificial intelligence systems are fully consistent with human rights, democracy and the rule of law, and aims to fill any legal gaps that may result from rapid technological advances. In this context, the obligations regulated by the AI Framework Convention will be applicable to public authorities or private actors acting on their behalf, and appropriate measures will be taken to ensure compliance with the aims and objectives of the AI Framework Convention for private sector actors.
Each party shall adopt necessary measures that seek to ensure that artificial intelligence systems are not used to undermine human rights, democratic institutions and processes, and freedom of thought. In addition, each party shall adopt measures regarding artificial intelligence systems to protect human dignity and individual autonomy, transparency and oversight, accountability and responsibility, equality and non-discrimination, privacy and personal data protection, reliability, and safe innovation.
Pursuant to the AI Framework Convention, each party is required to adopt measures to ensure that relevant information regarding artificial intelligence systems which have the potential to significantly affect human rights is documented, and to provide effective appeal and complaint mechanisms and procedural guarantees and rights to persons whose rights are affected by these artificial intelligence systems.
