tasfiye edilmeden \u015firketin veya kooperatifin ticaret sicilinden terkin edilece\u011fi baz\u0131 haller d\u00fczenlenmi\u015f ve bu kapsamda ticaret sicilinden terkin edilen \u015firketler ile kooperatiflerin ihyas\u0131n\u0131n terkin tarihinden itibaren be\u015f y\u0131l i\u00e7inde ileri s\u00fcr\u00fclebilece\u011fine h\u00fckmedilmi\u015fti.<\/p>\n<p>An\u0131lan d\u00fczenleme hakk\u0131nda sicilden terkin edilen \u015firketin ihyas\u0131 i\u00e7in a\u00e7\u0131lacak davan\u0131n ticaret sicilinden terkin tarihinden itibaren be\u015f y\u0131l ile s\u0131n\u0131rlanm\u0131\u015f olmas\u0131 sebebiyle ihya davas\u0131 a\u00e7\u0131lamad\u0131\u011f\u0131 gerek\u00e7esiyle somut norm denetimi ba\u015fvurusunda bulunulmu\u015ftur.<\/p>\n<p>Anayasa Mahkemesi, \u015firketlere ve kooperatiflere y\u00f6nelik alacaklar\u0131n m\u00fclk te\u015fkil etti\u011fine ve bu nedenle bu alacaklar\u0131n takip ve tahsil edilmesi hakk\u0131n\u0131n m\u00fclkiyet hakk\u0131n\u0131n bir uzant\u0131s\u0131 oldu\u011funa, s\u00f6z konusu kural\u0131n alacakl\u0131lar\u0131n veya hukuki menfaati olanlar\u0131n tasfiyeden haberdar olmas\u0131n\u0131 sa\u011flayacak g\u00fcvencelere yer vermedi\u011fini g\u00f6z \u00f6n\u00fcne alarak be\u015f y\u0131ll\u0131k dava a\u00e7ma s\u00fcresinin terkinin \u00f6\u011frenildi\u011fi ya da \u00f6\u011frenildi\u011finin makul olarak kabul edilebildi\u011fi tarih yerine terkin tarihinden ba\u015flat\u0131lmas\u0131n\u0131n ihya kurumunu i\u015flevsiz b\u0131rakabilece\u011fine ve b\u00f6ylece m\u00fclkiyet hakk\u0131n\u0131n ihlal edildi\u011fine karar vermi\u015ftir. Sonu\u00e7 olarak, Anayasa Mahkemesi \u201csilinme tarihinden itibaren be\u015f y\u0131l i\u00e7inde\u201d ibaresini iptal etmi\u015ftir.<\/p>\n<p>Anayasa Mahkemesi\u2019nin 22.06.2023 tarihli, 2023\/33 E., 2023\/117 K. say\u0131l\u0131 iptal karar\u0131, 15.09.2023 tarihli, 32310 say\u0131l\u0131 Resm\u00ee Gazete&#8217;de ilan edilmi\u015ftir.<\/p>\n<p>Herhangi bir sorunuz olmas\u0131
