AVKK, G\u00f6r\u00fc\u015f\u2019te (i) bir yapay zek\u00e2 modelinin ne zaman ve nas\u0131l anonimle\u015ftirilmi\u015f olarak de\u011ferlendirilebilece\u011fini, (ii) veri sorumlular\u0131n\u0131n \u00fcr\u00fcn\u00fcn geli\u015ftirme ve da\u011f\u0131t\u0131m a\u015famalar\u0131nda yasal dayanak olarak me\u015fru menfaatin uygunlu\u011funu nas\u0131l ortaya koyabilece\u011fini ve (iii) bir yapay zek\u00e2 modelinin geli\u015ftirilmesi a\u015famas\u0131nda ki\u015fisel verilerin hukuka ayk\u0131r\u0131 olarak i\u015flenmesinin yapay zek\u00e2 modelinin sonraki i\u015fleme ve i\u015fletilme s\u00fcre\u00e7lerini nas\u0131l etkileyece\u011fini tart\u0131\u015fmaktad\u0131r.<\/p><p>AVKK, anonimli\u011fin olay baz\u0131nda incelenmesi gerekti\u011fini ifade etse de anonimli\u011fi yapay zek\u00e2 modeline yap\u0131lan sald\u0131r\u0131lar veya model ile girilen etkile\u015fim yoluyla ve kullan\u0131lmas\u0131 makul olan t\u00fcm ara\u00e7lar kullan\u0131larak ki\u015fisel veri elde etmenin imk\u00e2ns\u0131z olmas\u0131 ko\u015fuluna ba\u011flayarak \u00e7\u0131tay\u0131 y\u00fckseltmektedir. Ayr\u0131ca G\u00f6r\u00fc\u015f\u2019te me\u015fru menfaat ko\u015fulunun \u00fc\u00e7 ad\u0131m testi de uygulan\u0131p yasal dayanak olarak kullan\u0131labilece\u011fi ve ki\u015fisel verilerin yapay zek\u00e2 modeli geli\u015ftirmek i\u00e7in zorunlu olmas\u0131n\u0131n da me\u015fru menfaat olarak de\u011ferlendirilebilece\u011fi ifade edilmektedir. G\u00f6r\u00fc\u015f\u2019te yapay zek\u00e2 modellerinde hukuka ayk\u0131r\u0131 olarak ki\u015fisel veri i\u015flenmesi hali de \u00fc\u00e7 senaryo \u00fczerinden tart\u0131\u015f\u0131lm\u0131\u015ft\u0131r. \u0130lk olarak, model geli\u015ftirmede ve da\u011f\u0131t\u0131m\u0131nda ki\u015fisel veri ayn\u0131 veri sorumlusu taraf\u0131ndan hukuka ayk\u0131r\u0131 olarak i\u015flenmi\u015ftir. Bu durumda somut olay baz\u0131nda de\u011ferlendirme yap\u0131lmal\u0131d\u0131r. \u0130kinci olarak, ki\u015fisel veri modelde tutulurken modelin da\u011f\u0131t\u0131m\u0131nda ba\u015fka bir veri sorumlusu taraf\u0131ndan i\u015flenmi\u015ftir. Bu durumda veri sorumlusu model da\u011f\u0131t\u0131c\u0131s\u0131n\u0131n modelin olu\u015fturulmas\u0131nda ki\u015fisel verinin hukuka uygun i\u015flenip i\u015flenmedi\u011fine dair inceleme y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fcn\u00fc yerine getirip getirmedi\u011fi dikkate al\u0131nacakt\u0131r. Son olarak da veri sorumlusu, ki\u015fisel veriyi yapay zek\u00e2 modeli geli\u015ftirmek i\u00e7in hukuka ayk\u0131r\u0131 olarak i\u015flemi\u015f, ancak sonra anonimle\u015ftirmi\u015ftir. Bu durumda veri i\u015flemenin hukuka ayk\u0131r\u0131l\u0131\u011f\u0131n\u0131n sonradan modelin da\u011f\u0131t\u0131m\u0131na etkisinin ge\u00e7memesi kayd\u0131yla modelin da\u011f\u0131t\u0131m\u0131 s\u00fcrecinin mevzuata ayk\u0131r\u0131 olmayaca\u011f\u0131 \u00f6ng\u00f6r\u00fclmektedir.<\/p><p>G\u00f6r\u00fc\u015f, yapay zek\u00e2n\u0131n geli\u015ftirilmesi s\u00fcrecinde ki\u015fisel verilerin korunmas\u0131na ili\u015fkin bir de\u011ferlendirme olarak b\u00fcy\u00fck \u00f6nem ta\u015f\u0131makla birlikte, \u00e7ok fazla belirsiz alan b\u0131rakmas\u0131 ve pratik bir \u015fekilde \u00e7e\u015fitli sorunlar\u0131 \u00e7\u00f6zmesi beklenen Hamburg tezini takip etmemesi nedeniyle uygulamadaki sorunlar \u0131\u015f\u0131\u011f\u0131nda G\u00f6r\u00fc\u015f\u2019\u00fcn ele\u015ftirilere maruz kalaca\u011f\u0131 \u00f6ng\u00f6r\u00fclmektedir.<\/p><p>Herhangi bir sorunuz olmas\u0131 halinde bize
